MISCONDUCT:  Ont. Reg. 991, ss. 14(1), 14(3), 14(4) and 16(4)1.

 

PARTICULARS OF THE COMPLAINT:

 

RIBO received notice on February 1, 2011 from the Principal Broker of Mr. Mujib Khokhar’s former employer regarding the activities of Mr. Khokhar who had been employed with their brokerage since December 18, 2006.

 

It is alleged that Mr. Mujib Khokhar arranged insurance for members of the public by completing applications and collecting cash payment but did not submit the applications to the insurance companies for processing or hand in the premium payments to be deposited to the trust account of the brokerage.

 

DISCIPLINE COMMITTEE’S DISPOSITION:

 

The Discipline Committee finds that Mr. Mujib Khokhar was properly served with the Notice of Hearing and Direction.

 

The Discipline Committee finds that it has jurisdiction to hear this matter as the events in question occurred during the time that Mr. Mujib Khokhar was registered with RIBO.

 

The Discipline Committee heard the testimony and reviewed the evidence given by clients of Mr. Khokhar and found their testimony and evidence to be reliable and forthcoming.

 

The Discipline Committee also heard the testimony of a representative on behalf of Mr. Khokhar’s former employer, whose testimony was consistent with that of the clients who had given testimony in this proceeding.

 

The Discipline Committee also heard the testimony and reviewed the evidence given by Mr. Mujib Khokhar.

 

Based on the evidence and submission, the panel accepts that there were multiple instances of Mr. Khokhar writing up applications, accepting premiums, failing to submit said applications for processing in a timely fashion and failing to deposit the premiums paid into the firm trust account.

 

Accordingly, the Discipline Committee further finds that the allegations contained in the Direction have been proven and finds that Mujib Khokhar is guilty as alleged therein.  The Discipline Committee therefore ordered:

 

(a)       That the Certificate of Registration of Mujib Khokhar be suspended for no less than 3 years from the date of this Decision.

 

(b)       That a recommendation be made to the Qualification and Registration Committee that they not consider any application by Mujib Khokhar to have the suspension removed until after October 18, 2015.
