PARTICULARS OF THE COMPLAINT:
Graydon David Cragg was in breach of an Order of the Discipline Committee dated April 1, 2010. Mr. Cragg was to have the accountant for his brokerage provide RIBO with written confirmation that as of May 31, 2010 the brokerage’s books and records were in full compliance with RIBO Reg. s. 17 and to be received in RIBO’s offices by no later than June 30, 2010; that RIBO receive audited Financial Statements for Mr. Cragg’s brokerage prepared by a publicly licensed accountant for three years commencing December 31, 2010, and thereafter as at December 31, 2011 and December 31, 2012 to be submitted to RIBO within six months after each respective year end.
Graydon David Cragg has not provided RIBO with the written confirmation that as of May 31, 2010 the brokerage’s books and records were in full compliance with RIBO Reg. s. 17; that the accountant of the brokerage has not provided RIBO with written confirmation that as of May 31, 2010 the brokerage’s books and records are in full compliance with RIBO Reg. s. 17, and that RIBO has not received the audited Financial Statements for the brokerage prepared by a publicly licensed accountant for December 31, 2010.
DISCIPLINE COMMITTEE’S DISPOSITION:
The Discipline Committee accepted the plea of guilty entered by counsel on behalf of Graydon David Cragg, and finds that Graydon David Cragg is guilty of breaching paragraphs 3(f) and (g) of the Decision dated April 1, 2010, and ordered:
(a) That the Certificate of Registration of Graydon David Cragg be revoked effective immediately.
(b) That a recommendation be made to the Qualification and Registration Committee that they not consider any application by Graydon David Cragg for his Level 2 license until after 5 years from the date of this Decision.
(c) That a recommendation be made to the Qualification and Registration Committee that they not consider any application by Graydon David Cragg for his Level 1 license until after 1 year from the date of this Decision.
(d) That Graydon David Cragg pay a fine in the amount of $5,000.00 by cheque made payable to the Minister of Finance and to be received by RIBO by no later than October 31, 2012.
