MISCONDUCT: Breach of an Order under the Discipline Committee dated November 19, 2008.
PARTICULARS OF THE COMPLAINT:
Ashmeade Insurance Brokers (hereinafter referred to as “Ashmeade Insurance”) and Webster Ashmeade as Principal Broker, has been in breach of an Amended Order of the Discipline Committee dated November 19, 2008, wherein Webster Ashmeade was ordered to pay a fine in the amount of $2,500.00 by cheque made payable to the Minister of Finance and to be received by RIBO by no later than December 31, 2008.
RIBO did not receive the cheque payable to the Minister of Finance, and therefore Webster Ashmeade was in breach of paragraph 3(b) of the said Order.
DISCIPLINE COMMITTEE’S DISPOSITION:
The Discipline Committee accepted the plea of guilty by Webster Ashmeade personally, and on behalf of Ashmeade Insurance, and accepts the evidence adduced by RIBO in support of the plea of guilty and finds that Ashmeade Insurance and Webster Ashmeade are guilty of breaching paragraph 3(b) of the Order dated November 19, 2008, and ordered:
(a) That Webster Ashmeade forthwith pays the outstanding fine in the amount of $2,500.00 payable to the Minister of Finance and to be received by RIBO no later than October 31, 2008.
(b) That the Certificate of Registration of Webster Ashmeade was suspended effective immediately pending receipt by RIBO and confirmation acceptable to RIBO of valid payment of the fine in the amount of $2,500.00 to the Minister of Finance.
