REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”), in particular sections 441.3 and 288.7

AND REGARDING Peel Therapy and Parth Patel

 

ORDER TO REVOKE LICENCE AND IMPOSE ADMINISTRATIVE MONETARY PENALTIES

 

On January 16, 2019, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal (the “Notice”) to revoke Peel Therapy’s service provider’s licence and to impose the following administrative monetary penalties:

-       $12,500 on Peel Therapy for submitting a form, plan, invoice, or other type of document or information authorized or required under the Statutory Accident Benefits Schedule that relates to a claim for statutory accident benefits or to a listed expense when the service provider had reasonable grounds to believe the form, invoice, document or information contained inaccurate, false, misleading, or deceptive information; and

 

-       $10,000 on Parth Patel for failing to take reasonable steps to ensure that Peel Therapy’s business systems and practices and management of its operations were carried on in accordance with the law and with integrity and honesty.

On January 21, 2019, the Superintendent sent the Notice to Peel Therapy and Parth Patel by registered and regular mail. Peel Therapy and Parth Patel had fifteen days to request a hearing.

On March 11, 2019, the Financial Services Tribunal confirmed that a Request for Hearing was not filed by Peel Therapy or Parth Patel or anyone on their behalf.

Subsection 288.7(7) of the Act provides that the Superintendent may carry out the proposal to revoke a service provider’s licence if no hearing has been requested.

Subsection 441.3(7) of the Act provides that the Superintendent may carry out the proposal to impose administrative monetary penalties if no hearing has been requested.

 

 

 

ORDER

The service provider licence of Peel Therapy (licence number SP15368) is hereby revoked.

An Administrative Monetary Penalty in the amount of $12,500 is imposed on Peel Therapy.

An Administrative Monetary Penalty in the amount of $10,000 is imposed on Parth Patel.

 

TAKE NOTICE THAT Peel Therapy and Parth Patel will be receiving shortly an invoice from Ontario Shared Services, a part of the Ministry of Government and Consumer Services, with information as to where and how to make the payment. Peel Therapy and Parth Patel must pay the Administrative Monetary Penalties no later than 6 months after the date of the invoice.

If Peel Therapy or Parth Patel fail to pay the Administrative Monetary Penalty in accordance with the terms of this Order, the Superintendent may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the Court. An Administrative Monetary Penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
