REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”), in particular sections 288.5 and 288.7;
AND REGARDING Eastend Medical Centre Incorporated
ORDER TO REFUSE APPLICATION
Eastend Medical Centre Incorporated (“Eastend”) is a corporation incorporated in Ontario (Ontario Corporation No. 2496430). Tharsha Varathalingam (“Ms. Varathalingam”) is the sole director of Eastend.
On February 11, 2016, Ms. Varathalingam filed an application with the Financial Services Commission of Ontario (“FSCO”) for a service provider licence on behalf of Eastend.
On November 19, 2018, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal to Refuse Application with respect to Eastend’s service provider licence application (the “Notice of Proposal”). The Superintendent determined that there were reasonable grounds to believe that Eastend is not suitable to be licensed. The Superintendent also determined that were reasonable grounds to believe that Eastend’s business systems and practices and the management of its operations will not be carried on in accordance with the law or with integrity and honesty.
The Notice of Proposal was sent by registered mail on December 4, 2018 and was received by Ms. Varathalingam on December 5, 2018. Eastend had until December 20, 2018 to file a request for hearing with the Financial Services Tribunal (the “Tribunal”).
On December 24, 2018, the Registrar of the Tribunal confirmed that neither Eastend nor anyone on its behalf requested a hearing in writing.
ORDER
The application for a service provider licence filed on behalf of Eastend Medical Centre Incorporated on February 11, 2016, is hereby refused.
