REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”), in particular sections 392.5 and 407.1

 

AND REGARDING Gerald Joseph Philippe Auger (“Mr. Auger”)

 

ORDER TO SUSPEND LICENCE

 

On February 9, 2018, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to suspend Mr. Auger’s insurance agent licence for three months for:

 

a)    failing to complete continuing education credits prior to the expiration of his licence for five consecutive licensing periods contrary to section 14 of O. Reg. 347/04; and

 

b)    providing false information on two licensing applications, contrary to subsection 8(b) of O. Reg. 347/04.

 

On February 27, 2018, Mr. Auger requested a hearing by the Financial Services Tribunal (“Tribunal”).  The Tribunal held a written hearing and on December 7, 2018, the Tribunal released its decision that the Superintendent carry out the Notice of Proposal to suspend Mr. Auger’s licence for three months. 

 

Pursuant to subsection 407.1(4), the Superintendent will carry out the proposal as ordered by the Tribunal.

 

ORDER

 

The insurance agent licence of Gerald Joseph Philippe Auger (licence #03079482) is hereby suspended for three months from the date of this order.
