REGARDING the Insurance Act, R.S.O. 1990, c. 1.8 (the “Act”), as amended, in

particular sections 441.1, 441.2 and 441.3

 

AND REGARDING 1789818 Ontario Limited O/A Concord Healthcare Management

 

 

ORDER FOR AN ADMINISTRATIVE PENALTY

 

1789818 Ontario Limited O/A Concord Healthcare Management (“Concord Healthcare Management”) was licensed as a service provider (licence # SP13379) under the Act.

 

On March 14, 2018, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal to Impose an Administrative Penalty in the amount of $2,500 on Concord Healthcare Management.

 

On April 24, 2018, the Notice was personally served upon Karen Marroquin, receptionist at Concord Healthcare Management. On the same day, a copy of the Notice was mailed to the attention of Patrick Chew, Concord Healthcare Management’s principal representative.

 

On June 7, 2018, a copy of the Notice was served upon Patrick Chew by telephone transmission of a facsimile of the document.

 

Concord Healthcare Management had 15 days after the Notice was given to request a hearing before the Financial Services Tribunal in accordance with subsections 441.3(2) and 441.3(5) of the Act.

 

On June 29, 2018, the Assistant Registrar of the Financial Services Tribunal confirmed that no request for a hearing has been received from 1789818 Ontario Limited O/A Concord Healthcare Management or anyone on its behalf in respect of the Notice.

 

Subsection 441.3(7) of the Act provides that the Superintendent may carry out the proposal to impose an administrative penalty when no hearing has been requested.

 

ORDER

An administrative penalty of $2,500 is hereby imposed on 1789818 Ontario Limited O/A Concord Healthcare Management.

TAKE NOTICE THAT 1789818 Ontario Limited O/A Concord Healthcare Management will be receiving shortly an invoice from Ontario Shared Services, a part of the Ministry of Government and Consumer Services, with information as to where and how to make the payment. 1789818 Ontario Limited O/A Concord Healthcare Management must pay the administrative penalty no later than 30 days after the date of the invoice.

If 1789818 Ontario Limited O/A Concord Healthcare Management fails to pay the administrative penalty in accordance with the terms of this Order, the Superintendent may file the Order with the Superior Court of Justice and the order may be enforced as if it were an order of the court. An administrative penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
