REGARDING the Insurance Act, R.S.O. 1990, c.I.8, as amended (the “Act”), in particular sections 392.5 and 407.1;
AND REGARDING Robert Chase Yancovitch
ORDER TO SUSPEND LICENCE AND TO ISSUE CONDITIONAL LICENCE
On May 8, 2017, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to Revoke Licence to Robert Chase Yancovitch (“Mr. Yancovitch”) regarding insurance agent licence #13133807 issued under the Act.
Mr. Yancovitch requested a hearing by the Financial Services Tribunal. Pursuant to Minutes of Settlement and Undertaking signed by Mr. Yancovitch and the Superintendent, and pursuant to a separate Undertaking signed by Mr. Yancovitch’s medical professional, Mr. Yancovitch and the Superintendent have agreed to the Orders set out below without a hearing.
ORDER TO SUSPEND LICENCE
The insurance agent licence #13133807 issued to Robert Chase Yancovitch under the Act is suspended until July 16, 2018.
ORDER TO ISSUE CONDITIONAL LICENCE
The insurance agent licence #13133807 is issued to Robert Chase Yancovitch effective July 16, 2018 subject to the following conditions that shall remain in force until July 16, 2020:
a) Mr. Yancovitch will meet with clients only in public places or via teleconference;
b) If an “in person” meeting with a client is necessary, a colleague or licensed professional or Mr. Yancovitch’s employer will accompany Mr. Yancovitch to the meeting and will remain present throughout the meeting;
c) Mr. Yancovitch will attend therapy sessions with his medical professional at least once per month;
d) The medical professional will send a report by e-mail to the Superintendent once per month.
