REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”), in particular section 441.4;

 

AND REGARDING Dan Fyke & Associates OT Services (SP13686) (the “Provider”)

 

 

 

ORDER IMPOSING SUMMARY ADMINISTRATIVE PENALTIES

 

 

The Provider holds a health care services provider licence. In a letter, dated November 15, 2017, sent to the Provider, a delegate of the Superintendent of Financial Services (“Superintendent”) advised of the intention to impose a summary administrative penalty of $1,000 against the Provider for failing to file the 2016 Annual Information Return by March 31, 2017, as required by subsection 21(1) of Ontario Regulation 90/14 made under the Act and a summary administrative penalty of $1,000 for failure to ensure the AIR contained information to enable the Superintendent to calculate the fee payable for the relevant period as required by section 21(2) of Ontario Regulation 90/14.

 

Pursuant to subsection 441.4(2) of the Act, the Superintendent gave the Provider the opportunity to make written submissions, which were to be received by the Superintendent’s delegate within the time specified in the letter. The Provider did make written submissions, which were taken into account in the decision to impose the summary administrative penalties.

 

Therefore, pursuant to subsection 441.4(1) of the Act and Items 53 and 54 of Schedule 3 of Ontario Regulation 408/12, the Superintendent orders summary administrative penalties against the Provider.

 

 

ORDER

 

Summary administrative penalties totalling $2,000 are imposed on Dan Fyke & Associates OT Services (SP13686).

 

 

TAKE NOTICE THAT the Provider will be receiving shortly an invoice from Ontario Shared Services, a part of the Ministry of Government and Consumer Services, with information as to where and how to make the payment. The Provider must pay the administrative penalties no later than 30 days after the date of the invoice.

If the Provider fails to pay the administrative penalty in accordance with the terms of this Order, the Superintendent may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the court. An administrative penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
