REGARDING the Insurance Act, R.S.O. 1990, c.I.8 (the “Act”), in particular sections 288.5, and 288.7
AND REGARDING Dynamic Care Rehab Center Inc.
ORDER
On November 24, 2014, Dynamic Care Rehab Center Inc. (“Dynamic Care”) applied to be licensed under the Act as a service provider.
On January 29, 2016, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to Refuse Application of Dynamic Care.
The Notice of Proposal was received by Dynamic Care on February 4, 2016. Dynamic Care had 15 days after receiving the Notice to request a hearing before the Financial Services Tribunal (“Tribunal”) in accordance with section 288.7(3) of the Act.
On March 7, 2016, the Registrar of the Tribunal confirmed that no request for a hearing has been received from Dynamic or anyone on its behalf.
Section 288.7(7) of the Act provides that the Superintendent may carry out the proposal to refuse to issue a licence when no hearing has been requested.
ORDER
The application for a service provider licence submitted by Dynamic Care Rehab Center Inc. on November 24, 2014, is refused.
