REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”) in particular sections 392.5 and 407.1;

 

AND REGARDING Joanna Blaszczyk, life and accident and sickness insurance agent

 

 

Joanna Blaszczyk (“Ms. Blaszczyk”) is a life insurance and accident and sickness insurance agent under the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”)

 

On May 11, 2015, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal to revoke the licence of Ms. Blaszczyk.

 

Ms. Blaszczyk requested a hearing before the Financial Services Tribunal in accordance with the Act. However, prior to the hearing, the parties entered into Minutes of Settlement. According to the terms of the settlement, Ms. Blaszczyk consented to an order under which her licence will be suspended for three months during which time she will complete an ethics course approved by the Superintendent, she will be subject to supervision for one year by a supervisor approved by the Superintendent and will further pay an Administrative Monetary Penalty in the amount of $1,500. Also, in accordance with the Minutes of Settlement, Ms. Blaszczyk was required to withdraw the hearing request. Ms. Blaszczyk did withdraw the hearing request on February 3rd, 2016.

 

Therefore, in accordance with the Minutes of Settlement, the Superintendent issues the following order:

 

 

 

 

ORDER

 

 

1.    I hereby order the suspension of the life insurance and accident and sickness insurance agent licence of Joanna Blaszczyk commencing on February 15, 2016 for a period of three (3) months or until Ms. Blaszczyk provides evidence of satisfactory completion of a course on professional ethics, responsibility and compliance as described below, whichever is later.

 

2.    I hereby further order that Ms. Blaszczyk complete a course on professional ethics, responsibility and compliance, which course is to be approved in advance by the Superintendent, and that she provide the Superintendent with proof of her successful completion of the course and do so prior to her licence being reinstated.

 

3.    I hereby further order that Ms. Blaszczyk be supervised for a period of one (1) year following the expiration of her licence suspension commencing on the date on which she returns to work. The proposed supervisor must be a duly licensed life insurance agent approved by the Superintendent, whose name, details and role Ms. Blaszczyk will submit to the Superintendent for his approval.

 

4.    I hereby further order that Ms Blaszczyk pay an Administrative Monetary Penalty in the amount of fifteen hundred dollars ($1,500) for furnishing the Superintendent with false, misleading or incomplete information in her licence renewal application.

 

 

TAKE NOTICE THAT you, Joanna Blaszczyk, will receive an invoice from Ontario Shared Services, a part of the Ministry of Government and Consumer Services, with information as to where and how to make the payment.

 

FURTHER, TAKE NOTICE THAT you, Joanna Blaszczyk, must pay the administrative penalty no later than 30 days from the date of the invoice.  If you fail to pay the Administrative Monetary Penalty in accordance with the terms of this Order, the Superintendent may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the court. An Administrative Monetary Penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
