REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended (the “Act”), in particular sections 288.5 and 288.7
AND REGARDING 2382514 Ontario Ltd. operating as Back to Life Physiotherapy Corporation
ORDER
On December 29, 2014, 2382514 Ontario Ltd. operating as Back to Life Physiotherapy Corporation applied to be licensed under the Act as a service provider. This application was submitted on the corporation’s behalf by Mr. Shanchayan Rajasingam.
On May 22, 2015, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to Refuse Application and the Notice, along with reasons, was served on 2382514 Ontario Ltd. The Notice and reasons were sent by registered mail and received by Mr. Rajasingam on June 15, 2015.
2382514 Ontario Ltd. had 15 days after service of the Notice to request a hearing before the Financial Services Tribunal (“Tribunal”) in accordance with subsection 288.7(3) of the Act.
On July 2, 2015, the Registrar of the Tribunal confirmed that no request for a hearing has been received from 2382514 Ontario Ltd. or anyone on its behalf.
Subsection 288.7(7) of the Act provides that the Superintendent may carry out the proposal to refuse to issue a licence when no hearing has been requested.
ORDER
The application for a service provider licence submitted by 2382514 Ontario Ltd. operating as Back to Life Physiotherapy Corporation on December 29, 2014, is hereby refused.
