AND IN THE MATTER OF Warden Wellness Centre Ltd (“Warden Wellness”);

 

AND IN THE MATTER OF Anusuya Gobinathan (“Gobinathan”).

 

 

ORDER TO REVOKE LICENCE AND

TO IMPOSE ADMINISTRATIVE PENALTY

 

 

Warden Wellness is a licensed as a service provider under the Act (licence #SP18987) from December 20, 2023.

 

Gobinathan is the Principal Representative and the sole director and officer of Warden Wellness.

 

On September 11, 2024, by delegated authority from the Chief Executive Officer of the Financial Services Regulatory Authority of Ontario (the “Chief Executive Officer”), the Director, Litigation and Enforcement (the “Director”) issued a Notice of Proposal to revoke the service provider’s licence issued to Warden Wellness and to impose an administrative penalty in the total amount of $10,000 on Gobinathan.

 

A Request for Hearing (Form 1) dated September 20, 2024, was delivered to the Financial Services Tribunal (the “Tribunal”) in accordance with sections 407.1(3) and 441.3(5) of the Act respecting the Notice of Proposal.

 

Gobinathan failed to attend a Prehearing Conference on January 27, 2025. The Tribunal issued a Notice of Intention to Dismiss dated January 27, 2025. The proceeding was not dismissed at this time.

 

Gobinathan again failed to attend a Prehearing Conference on June 5, 2025. As such, the Tribunal issued a Dismissal of Proceeding dated June 5, 2025 and directed that FSRA proceed with its Notice of Proposal.

 

 

ORDER

 

The service provider licence (licence #SP18987) issued to Warden Wellness Centre Ltd. is hereby revoked for the reasons set out in the Notice of Proposal.

ORDER

 

An administrative penalty of $10,000 is hereby imposed on Anusuya Gobinathan for the reasons set out in the Notice of Proposal.

 

TAKE NOTICE THAT the Financial Services Regulatory Authority of Ontario will deliver an invoice to Anusuya Gobinathan with information as to where and how to pay the administrative penalty. Anusuya Gobinathan must pay the administrative penalty no later than thirty (30) days after the date of the Tribunal’s decision or as otherwise agreed.

 

If Anusuya Gobinathan fails to pay the administrative penalty in accordance with the terms of this Order, the Chief Executive Officer may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the Court. An administrative penalty that is not paid in accordance with the terms of the order imposing the penalty is a debt due to the Crown and is enforceable as such.
