IN THE MATTER OF the Insurance Act, R.S.O. 1990, c.I.8, as amended (the “Act”), in particular section 288.6(3);
AND IN THE MATTER OF Eglinton Square Orthotic and Wellness Inc. (the “Licensee”).
ORDER TO REVOKE LICENCE
The Licensee is licensed as a service provider (licence # SP17727) under the Act.
Pursuant to section 21(1) of Ontario Regulation 90/14, the Licensee was required to submit an Annual Information Return for the year 2020 (“AIR”) on or before March 31st of the following year. The deadline to file the AIR for 2020 was extended to June 30, 2021. The Licensee failed to submit the AIR before the deadline, and to date has not submitted the AIR despite multiple reminders and requests between the period of February 2021 to September 2021.
Section 21(2) of Ontario Regulation 90/14 requires a licensed service provider to ensure that the annual information return contains such information as will enable the Chief Executive Officer of the Financial Services Regulatory Authority of Ontario (the “Chief Executive Officer”) to calculate the amount of the Annual Regulatory Fee (“ARF”) payable by the service provider under the Act. By failing to submit the AIR, the Licensee has failed to pay the ARF imposed pursuant to section 4.3 of the Financial Services Regulatory Authority of Ontario Rule 2019-001.
Therefore, pursuant to section 288.6(3) of the Act, section 4.3 of the Financial Services Regulatory Authority of Ontario Rule 2019-001, and by delegated authority from the Chief Executive Officer, the Head, Licensing and Risk Assessment (the “Head”) makes the following order:
ORDER
The service provider’s licence (licence # SP17727) issued to Eglinton Square Orthotic and Wellness is hereby revoked for the reasons set out above.
