AND IN THE MATTER OF 2517605 Ontario Inc. o/a Meditecs Independent Medical Examinations

                                   

 

ADMINISTRATIVE PENALTY ORDER

 

 

2517605 Ontario Inc. o/a Meditecs Independent Medical Examinations (“Meditecs”) is a service provider licensed under the Act.  Omar Irshidat is the Principal Representative of Meditecs.  

 

On November 9, 2018, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal (“Notice”) to impose administrative penalties in the aggregate amount of $2,500.00 on Meditecs, for failing to comply with sections 5, 15 and 17 of Ontario Regulation 90/14 by having deficiencies in patient identity verification, failing to keep the HCAI Rostered Health Professionals List updated, and having deficiencies in Meditecs’ own written policies and procedures.  

 

The Notice was served on Meditecs on November 13, 2018.

 

Meditecs had 15 days after the Notice was given to request a hearing before the Financial Services Tribunal (“Tribunal”) in accordance with subsection 441.3(5) of the Act.

 

Meditecs requested a hearing on December 7, 2018.

 

On June 27, 2019, the Tribunal issued a decision that it had no jurisdiction to proceed with the hearing and held that the proposals outlined in the Notice could be carried out. No appeal has been filed with respect to the Tribunal’s decision.

 

Effective June 8, 2019, the Chief Executive Officer for the Financial Services Regulatory Authority of Ontario succeeded the Superintendent as the regulator of service providers under the Insurance Act pursuant to the Financial Services Regulatory Authority of Ontario Act, 2016.      

 

 

 

 

 

 

 

ORDER

 

An administrative penalty in the amount of $2,500 is imposed on 2517605 Ontario Inc. o/a Meditecs Independent Medical Examinations.

 

TAKE NOTICE THAT 2517605 Ontario Inc. o/a Meditecs Independent Medical Examinations will be receiving an invoice from the Financial Services Regulatory Authority with information as to where and how to make the payment.  2517605 Ontario Inc. must pay the administrative penalty no later than 30 days after the date of the invoice.

 

If 2517605 Ontario Inc. fails to pay the administrative penalty in accordance with the terms of this Order, the Chief Executive Officer may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the court.  An administrative penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
