In the Matter of the FINANCIAL INSTITUTIONS ACT (RSBC 1996, c.141) (the "Act")

and the INSURANCE COUNCIL OF BRITISH COLUMBIA ("Council")

and NIZARTIGHZA (the "Licensee")

DECISION AND ORDER UNDER SECTIONS 231 & 238 OF THE ACT

WHEREAS the Licensee currently holds a life and accident and sickness insurance ("Life Agent") licence in British Columbia, and has been licensed in British Columbia since 2015;

AND WHEREAS the Licensee is the subject of investigation by Council due to complaints received by Council in January 2019, May 2019, and June 2019;

AND WHEREAS Council requested on November 27, 2019 that the Licensee provide Council with information relating to his errors and omissions insurance, which licensees are required to carry by Council Rule 7(11), as well as with information relating to whether he has a contract with an insurer, as is required of licensees by Council Rule 7(16);

AND WHEREAS the Licensee responded to Council's November 27, 2019 request by email on December 10,2019, stating that he would not provide the required information;

AND WHEREAS Council sent a second request for information to the Licensee on December 12, 2019, with a deadline for providing the information of January 6,2020, which the Licensee did not comply with;

AND WHEREAS Council sent a final request for information to the Licensee on January 31,2020, with a deadline for providing the information of February 14, 2020, which the Licensee did not comply with;

AND WHEREAS Council, having taken into consideration the multiple complaints received about the Licensee and the Licensee's failure to cooperate with Council, believes it to be in the interests of the public forthe Licensee to be suspended until such time as he has complied with Council's request for information;

NOWTHEREFORE Council orders that the Licensee's Life Agent licence be suspended pursuant to sections 231 and 238 of the Act, to be effective the date of this order, until such time as the Licensee provides to Council:

a) A copy of the declaration page of the Licensee's errors and omissions insurance for the calendar years 2017,2018, and 2019; and

b) A copy of a contract between the Licensee and at least one insurer for the calendar years 2017, 2018, and 2019.

TAKE NOTICE that, pursuant to section 238 of the Act, the Licensee has the right to require a hearing on this order before Council by delivering written notice within 14 days of receipt of this order to Council at Suite 300,1040 West Georgia Street, Vancouver, British Columbia, V6E 4H1; alternatively, the Licensee may appeal this order to the Financial Services Tribunal.
