REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended, in particular sections 392.4 and 407.1

 

AND REGARDING Janice Somersall-French

 

ORDER TO REFUSE LICENCE RENEWAL

On April 20, 2017, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to Refuse Application regarding the application to renew the insurance agent licence of Janice Somersall-French (“Ms. Somersall-French”). The Notice of Proposal was sent by mail and registered mail to the address listed as Ms. Somersall-French’s mailing address. Canada Post records indicate that the letter sent to Ms. Somersall-French by registered mail was received on April 24, 2017.

Ms. Somersall-French had 15 days after service of the Notice to request a hearing before the Financial Services Tribunal (“Tribunal”) in accordance with subsection 407.1(3) of the Insurance Act (the “Act”).

On May 10, 2017, the Registrar of the Tribunal confirmed that no request for a hearing has been received from Ms. Somersall-French.

Subsection 407.1(7) of the Act provides that the Superintendent may carry out the proposal to refuse to renew a licence when no hearing has been requested.

ORDER

The application to renew the life insurance agent licence of Janice Somersall-French is hereby refused.
