REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended, in particular sections 392.4 and 407.1
AND REGARDING Nigel Scott
ORDER
On December 5, 2016, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to Refuse Application for a Life Insurance and Accident & Sickness Insurance agent licence to Nigel Scott (“Mr. Scott”). The Notice of Proposal was sent by mail and registered mail to the address listed as Mr. Scott’s mailing address. Canada Post records indicate that the letter sent by registered mail was successfully delivered.
Mr. Scott had 15 days after service of the Notice of Proposal to request a hearing before the Financial Services Tribunal (“Tribunal”) in accordance with subsection 407.1(3) of the Insurance Act (the “Act”).
On January 3, 2017, the Registrar of the Tribunal confirmed that Mr. Scott did not make a request for hearing.
Subsection 407.1(7) of the Act provides that the Superintendent may carry out the proposal when no hearing has been requested.
ORDER
The application for a Life Insurance and Accident & Sickness Insurance agent licence to Nigel Scott is hereby refused.
